Description of case: Plaintiff alleged the defendant cardiologist failed to inform the decedent about the results of a chest X-ray that showed a potential lung mass. But the cardiologist did not order the chest X-ray and was not informed of its results. Thus, a plea in bar based on Va. Code § 8.01-581.18:1 was asserted, and a jury trial was requested. After a three-day trial and approximately 45 minutes of deliberations, the jury returned a defense verdict.
