Description of case: The plaintiff, in his 50s, was driving from
Richmond to a finance conference in Tennessee when he was rear-ended by a truck in Augusta County. He was taken to a nearby hospital where he was treated and released that day.
He left the hospital, rented a car and drove to Richmond to catch a plane to Tennessee for the conference. He began having symptoms of headaches, dizziness, forgetfulness, word-finding issues and irritability. His condition worsened and he eventually had to leave his job, where he lost benefits. He started a new job at a lower salary.
The case was negotiated before suit was filed with the final offer being $450,000, which was rejected. Suit was filed and the attorneys exchanged key information, leading to a mutually agreeable settlement of $1.3 million.
